https://universnellygrosjean.com (hereinafter referred to as the « site or UNG ») is an information and electronic commerce site accessible by the Internet network, open to any user of that network (hereinafter referred to as « Internet user »).

It is published by the company Moulin de Vies, Sàrl based in Plateau de Diesse, canton Bern, which was founded in 2015. Its UID identification number is CHE-162.694.682. It is active in the sector « body maintenance ». Today, people in decision-making roles are Nelly Yvette Grosjean (Associate and Managing). Chemin des Moulins 1, 2015. Lamboing.

The Site allows for the sale of essential oils and aromatherapy (hereinafter referred to as the « Products ») to Internet users navigating the Site (hereinafter referred to as « Users »).

The User who has validated an order will be named « Client ». The rights and obligations of the User necessarily apply to the Customer.
Any order for a Product offered on the Site presupposes consultation and express acceptance of these terms and conditions of sale and withdrawal, manifested by the fact of checking the box « I declare that I have read and accepted the terms and conditions of sale and that I am informed of my right.

Article 1 – OBJECTIVE

The purpose of these general terms and conditions of sale is to define, exclusively because of the relationship they establish on the Internet, the rights and obligations of the Parties arising from the online sale of the Products offered on the Website. They shall regulate all steps necessary for the placing of the order and shall monitor such order between the Parties. These apply to the exclusion of any other
document.

 

ARTICLE 2 – PRODUCTS

2.1 Products
Products offered for sale are those appearing on the Site, on the day the User consults the Site and within the limits of available stocks. In case of unavailability of any of the Products, the customer will be informed as soon as possible. Photographs, videos and texts illustrating the Products do not fall within the contractual scope.

2.2 Use of products
Essential oils are very powerful concentrates and can be dangerous if not used properly. The Customer must be aware of the precautions for use before using the Products. UNIVERS NELLYGROSJEAN will not be liable for any damage caused by misuse of any of its Products or failure to comply with the precautions of use and the conditions of hygiene and safety when using any of its Products. For use of essential oils for therapeutic purposes, you are reminded to consult an expert in aromatherapy.

2.3 Product sales
Resale of products is not permitted unless the company agrees in writing. Repackaging of products for resale under another trade mark is not permitted unless the company agrees in writing

ARTICLE 3 – PRICES

Prices are shown in Euros and are valid for the European Union territories. They shall take into account any reductions as well as Swiss VAT applicable on the day of the order.

Any order placed on the Site and delivered outside the European Union will be invoiced without VAT and may be subject to any taxes, customs duties and other related charges imposed when the parcel reaches its destination. These additional costs are the responsibility of the Customer.
The prices indicated on the Site are guaranteed on the day of the order within the limits of available stocks, and unless there is a manifest error of typography or omission. The prices indicated do not take into account the shipping costs which will be charged in addition or offered according to the amount of the order and the country of delivery, and will be specified to the User upon final validation of his order. These shipping costs do not include customs and other ancillary costs which may be charged at the entry of certain countries, these costs remain the exclusive responsibility of the customer. BIOSSENTIAL reserves the right, as the User agrees, to change its prices at any time.

ARTICLE 4 – THE ORDER PROCESS

4.1 Navigation inside the Site
The User may take notice of the different Products offered for sale by BIOSSENTIEL on the Site, and the User may browse the different pages of the Site without being engaged as an order.

4.2 Registering an order If the User wishes to place an order, he will put the Products in the basket. To order the Products he has chosen, after clicking on « ORDER », any User will have to identify himself, by entering his e-mail address as well as the password he has previously chosen when creating his account, i.e. if it is his first order, by clicking on « Create my account ». In the latter case, the User will be required to complete the exact form available to him or her, including the information necessary for his or her identification, including his or her surname, first name and postal address. In addition, the User shall provide his/her e-mail address and a password of his/her choice which will be personal and confidential and which he/she will need to identify later on the Site. The User is informed and accepts that the seizure of these two identifiers is proof of his identity and his consent. Once the User is identified, he will have to validate the delivery address and then a purchase order will appear on the screen, summarizing: quantity and prices of the Selected Products, as well as the total amount of the order, shipping costs, user contact details, delivery address of the Products.

4.3 Final validation of the order and payment
After having read the status of his order, and once all the requested information has been completed by the User, a summary of this information and the order will appear and the latter will have to choose the method of payment with which he wishes to make his payment to confirm his order definitively. Orders are payable in euros by French or international bank card, bank transfer France or European or by French cheque.
It is specified that by making an immediate payment by credit card, the User will then be automatically switched to the monetary server of the secure payment platform. This platform is secured by S.S.L. encryption (Secure Socket Layer) to protect all data related to means of payment.
As soon as it validates its payment, the order is registered. User becomes Customer. The purchase order will be considered proof of the contractual relations between the Parties. The Customer has a right of withdrawal and refund, for a period of fourteen (14) working days from the date of receipt of the Products by the Customer.

4.4. Confirmation of control
A summary of the command will display once the command is validated. This confirmation will include all the elements of the contract between the Parties. This order summary will also be sent by email to the Customer within minutes of purchase.

ARTICLE 5 – DELIVERY

Time limits and shipping methods
Your orders are processed as soon as possible by Customer Service and Shipping Service, open Monday to Friday included. Orders are prepared upon receipt of payment, payment by credit card guarantees you the speed of processing your order.

Delivery time in metropolitan France
Shipments take place within 72 hours of receipt of payment of your order, unless otherwise indicated at the level of the page « basket ».

Delivery time in the rest of the world
Your order will be delivered by our selected carrier depending on the country of destination.

Loss of packages during transport
Colissimo are very reliable services. However, as in any shipment, there may be a delay in delivery or the package may be lost. In the case of a delay of more than 7 days, the Customer will have to inform the BIOSSENTIEL customer service which will forward the information to the Post Office to trigger the opening of an investigation. This investigation may last up to 21 days from its opening. If during this period the parcel is found, it will be returned immediately to the customer's home (in the majority of cases). If, on the other hand, the package is not found after the 21-day investigation period, Colissimo considers the package to be lost. In this case, BIOSSENTIEL will return to the Customer a replacement package at its own expense. If the lost product(s) were no longer available at that time, BIOSSENTIAL would reimburse the Customer for the amount of these products.

Anomalies
Any anomalies concerning the delivery (garrie, open parcels, damaged parcels, broken products...) must be indicated on the delivery note in the form of « handwritten reservations », accompanied by the Customer's signature. The Customer must immediately notify the BIOSSENTIAL Customer Service of the anomaly so that a complaint can be made to Colissimo. BIOSSENTIAL will return the replacement product(s) to the Customer at its own expense.

ARTICLE 6 – RETURN AND RIGHT OF RETRACTATION

Conditions for withdrawal
The Customer has a right of return of fourteen (14) days from receipt of the entire order to retract without necessarily giving any reason. To exercise the right of withdrawal, the customer must notify his/her decision to withdraw his/her order by a written declaration stating his/her surname and first name, e-mail, address, number and date of order. The Customer must send this information by email to info @ bioessential.com

Refund
In the event of withdrawal from the Customer, UNG will refund the payments received from the Customer without undue delay and, in any event, not later than fourteen (14) days from the day on which UNG is informed of the Customer's withdrawal decision. The refund will be made by the same means of payment as the Customer used for his order or by bank transfer. UNG may defer the refund until receipt and verification of the Product(s).

Return of products
The Customer must return the Products no later than fourteen (14) days after having communicated his decision to withdraw. Returned products must be unstarted, complete and not damaged. The Customer supports the costs of returning the complete order or Products. The return of the packages must be made at the following address: 3213 old chemin d'Arles, 13690 Graveson-en-Provence, France

ARTICLE 7 – INFORMATION AND FREEDOMS

Information on the name information collected in the context of distance selling is mandatory, as this information is necessary for the processing and delivery of orders and for the preparation of invoices. In accordance with Article 34 of the Law of 6 January 1978, the Customer has the right to access, modify, rectify and delete the data concerning you. ARTICLE 8 – LITIGES
In the event of a dispute, the Customer will first contact the company to obtain an amicable solution. In the absence of an amicable agreement between the Parties, the dispute shall be brought before the French courts, unless otherwise provided by law.
